Professional indemnity insurance

Under the National Law, nurses must not practise the profession in which they are registered unless they hold appropriate professional indemnity insurance (PII) arrangements for their practice. Section 129(1) of the National Law says a registered health practitioner must not practise unless appropriate PII arrangements are in force.

The NMBA describes PII arrangements as arrangements that insure the nurse's professional practice against civil liability, or loss, arising from a claim made because of a negligent act, error or omission in the nurse's conduct.

The NMBA's Registration standard: Professional indemnity insurance arrangements came into effect on 1 June 2016 and sets out the details. A fact sheet supports it; the NMBA website lists its date of effect as March 2026.

The Department of Health and Aged Care says the legislated need for collaborative arrangements between NPs and medical practitioners for MBS services and PBS prescribing was removed from 1 November 2024. It says it told PII providers about the change so their products removed references to collaborative arrangements. See PBS prescribing and MBS items.
